General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) apply to all contracts concluded via the eBay online shop between:

– hereinafter referred to as the “Seller”

and the customer – hereinafter referred to as the “Buyer” – through the eBay platform.

Any deviating terms and conditions of the Buyer shall not apply unless the Seller expressly agrees to them in writing.


2. Conclusion of Contract

The conclusion of the contract is governed by the eBay Terms and Conditions, in particular § 6 of the eBay T&Cs:

  • For fixed-price items, the contract is concluded by clicking the “Buy It Now” button or by selecting “Add to Cart” and confirming the purchase process.

  • For auction items, the contract is concluded with the highest bid at the end of the auction period.

By listing an item on eBay, the Seller makes a binding offer to conclude a purchase contract for that item.

The contract text is stored by eBay after conclusion and can be viewed by the Buyer under “My eBay”.
The contract language is German.


3. Prices and Payment Terms

All prices are final prices and include statutory value-added tax (VAT).
Any shipping costs in addition to the purchase price are specified separately in the respective eBay listing.

Payment is made at the Buyer’s choice via one of the payment methods offered by eBay (e.g., PayPal, credit card, Apple Pay, Klarna, etc.).
The purchase price is due immediately.
The Seller reserves the right to ship the goods only after full payment has been received.


4. Delivery and Shipping Conditions

Delivery is made within Germany and – where indicated in the listing – also to other EU countries.

The standard delivery time is 2–5 working days from receipt of payment, unless otherwise stated in the item description.
The goods will be shipped to the delivery address provided by the Buyer on eBay.

Self-collection is possible only by prior arrangement.


5. Retention of Title

The goods remain the property of Critch GmbH until payment has been made in full.


6. Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal in accordance with the cancellation policy included in the item description.
Entrepreneurs within the meaning of § 14 of the German Civil Code (BGB) are not granted a right of withdrawal.


7. Return Costs in the Event of Withdrawal

Unless otherwise stated in the offer, the Buyer bears the direct cost of returning the goods.


8. Warranty (Liability for Defects)

The statutory provisions on liability for defects pursuant to §§ 434 et seq. BGB apply.

For used items, the warranty period is one year from delivery of the goods, provided the Buyer is a consumer.
For entrepreneurs, the warranty period is limited to one year from the transfer of risk.

No liability is accepted for damages resulting from improper use, incorrect installation, or normal wear and tear.


9. Liability

The Seller shall be fully liable:

  • in cases of intent or gross negligence,

  • for injury to life, body, or health.

In the case of slight negligence involving a breach of essential contractual obligations (cardinal obligations), liability is limited to the foreseeable, typical damage.
In all other cases, liability is excluded.


10. Data Protection

The Seller processes personal data of the Buyer exclusively in accordance with the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG).

Data will only be shared to the extent necessary for contract execution (e.g., with shipping or payment service providers).

11. Dispute Resolution

The European Commission provides a platform for Online Dispute Resolution (ODR):

The Seller is not obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.


12. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If the Buyer is a consumer, this choice of law applies only insofar as it does not deprive the consumer of the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence.

The place of jurisdiction for disputes with entrepreneurs is Munich, Germany.

Should any provision of these GTC be invalid, the validity of the remaining provisions shall not be affected.
